208 Dual Participation: SNAP/Tribal Commodities Food Distribution Program on Indian Reservation
Overview
An individual cannot participate in the Supplemental Nutrition Assistance Program in any month when he/she has received SNAP benefits in another state or commodities from the Food Distribution Program on Indian Reservations (FDPIR).
Exception:
-
Current certified SNAP household members who enter a designated abuse shelter
A public or private non-profit abuse shelter that serves abused individuals. If such a facility serves other individuals, a portion of the facility must be set aside on a long-term basis to serve only abused individuals. may apply and be eligible
Having met the qualifications to receive a SNAP benefit by meeting the specified nonfinancial and financial requirements of eligibility. for SNAP benefits in the same month provided that the original certified household contained the abuser. Abuse shelter residents may receive an additional benefit as a separate household only once a month.

Households certified in either Tribal Commodities/Food Distribution Program on Indian Reservation
The geographically defined area over which an Indian Tribal Organization (ITO) exercises governmental jurisdiction as long as the area is legally recognized by the Federal or State government as being set aside for the use of Indians. (FDPIR) or SNAP on the first day of the month can only receive benefits in the program for which they are currently certified for the month.
Households may choose to receive Tribal Commodities/FDPIR when the SNAP benefit is zero due to proration. If eligible for Tribal Commodities/FDPIR, the household can be certified for one month only.
Note: Residents of Puerto Rico may receive benefits like SNAP benefits called Nutrition Assistance Program (NAP). When a person from Puerto Rico establishes North Dakota residence and applies for benefits, treat his or her NAP as follows:

The NAP benefit is not income, and
-
SNAP benefits can be issued in North Dakota even if NAP was issued during the same month as the SNAP application
Filing a signed Application for Assistance via paper application or through the self-service portal of the eligibility system to establish eligibility and assign a review period.. NAP benefits cannot be used in the mainland United States, so there is no duplication of benefits if SNAP is issued for the same month as NAP.

If dual participation is identified, the State or Tribal Commodities/FDPIR where duplicate benefits were authorized establishes the claim.
Note:If the household did not report receiving SNAP in another State or Tribal Commodities from an FDPIR, a disqualification for intentional program violation (IPV) should be pursued. An individual disqualified for (IPV) from SNAP is disqualified from not only the SNAP but also from receiving Tribal Commodities from FDPIR.

Contact the other state at application or when a change Information that is different from what is currently used to determine eligibility and/or benefits. in household composition is reported for the following:

A household reports received SNAP benefits in another State.

A household or new household member recently moved from another State.

Contact the Tribal Commodities/FDPIR at application, recertification, or when a change in household composition is reported for the following:

A household residing on an Indian reservation; OR
-
A household residing in the service area for Tribal Commodities/FDPIR, and there is a household member that is an enrolled tribal member of any tribe; OR
-
A household relocating from one of the areas in #1 & #2 referenced above.
